\u00a7 1. General Provisions<\/strong><\/p>\n\n

These Terms of Sale set out the rules for placing orders, entering into and performing sales contracts, delivery, payment, complaints, withdrawal from the contract, and use of the voluntary \"Lifetime Warranty\" for products offered under the Zdunek Knives brand.<\/p>\n\n

The Seller and owner of the ZdunekKnives.com website is Revasdomo sp. z o.o., headquartered in Warsaw at ul. F. Klimczaka 17 lok. 80, 02-797 Warsaw, Poland, entered in the Polish register of entrepreneurs (KRS) under number 0000352727, NIP: 5213559751, REGON: 142330760, email: info@revasdomo.pl, phone: +48 608 432 705, hereinafter the \"Seller.\"<\/p>\n\n

A Customer may be a natural person, a legal entity, or an organizational unit with legal capacity. A Customer who is a natural person, by placing an order, represents that they are at least 18 years old and have full legal capacity, unless entering into the contract to the extent permitted under applicable law.<\/p>\n\n

Products offered by the Seller include, in particular, ready-made handmade knives and knives made to the Customer's individual order.<\/p>\n\n

Information presented on the site, in catalogs, on social media, or in business correspondence does not constitute an offer within the meaning of the Polish Civil Code, but an invitation to enter into a contract.<\/p>\n\n

These Terms are made available to the Customer free of charge before the contract is concluded, in a way that allows them to be obtained, reproduced, and saved.<\/p>\n\n

\u00a7 2. Definitions<\/strong><\/p>\n\n

For the purposes of these Terms, the following definitions apply:<\/p>\n\n

Business days \u2014 Monday through Friday, excluding statutory holidays in Poland.<\/p>\n\n

Customer \u2014 the party placing an order or entering into a contract with the Seller.<\/p>\n\n

Consumer \u2014 a natural person entering into a legal transaction with the Seller that is not directly related to their business or professional activity.<\/p>\n\n

Privileged entrepreneur \u2014 a natural person running a business who enters into a contract directly related to that business, where the content of the contract shows that it does not have a professional character for that person, as determined in particular by the nature of their business as registered in the Polish CEIDG register; such a Customer is treated under these Terms as a Consumer to the extent required by mandatory law.<\/p>\n\n

Ready-made product \u2014 a product that has already been made and is available for sale without requiring personalization or production to the Customer's individual specification.<\/p>\n\n

Custom product \u2014 a non-prefabricated product made to the Customer's specifications or intended to meet their individualized needs.<\/p>\n\n

Contract \u2014 a sales contract entered into between the Seller and the Customer.<\/p>\n\n

Durable medium \u2014 material or a tool that allows the Customer to store information in a way accessible for future reference for a period appropriate to the purpose of that information.<\/p>\n\n

\u00a7 3. Contacting the Seller and Required Information<\/strong><\/p>\n\n

The Customer may contact the Seller via:<\/p>\n\n

\u00a0\u00a0\u00a0email: info@revasdomo.pl;<\/p>\n\n

\u00a0\u00a0\u00a0phone: +48 608 432 705;<\/p>\n\n

\u00a0\u00a0\u00a0the contact form available on the site;<\/p>\n\n

\u00a0\u00a0\u00a0traditional mail sent to the Seller's registered address.<\/p>\n\n

Before the contract is concluded, the Seller provides the Customer with, in particular, information about:<\/p>\n\n

\u00a0\u00a0\u00a0the main characteristics of the ordered product;<\/p>\n\n

\u00a0\u00a0\u00a0the total price of the product or how it will be calculated, if the nature of the product doesn't allow it to be reasonably assessed in advance;<\/p>\n\n

\u00a0\u00a0\u00a0delivery costs, customs duties, import taxes, and other costs charged to the Customer, where applicable or where they cannot reasonably be calculated in advance;<\/p>\n\n

\u00a0\u00a0\u00a04) terminie realizacji zam\u00f3wienia;<\/p>\n\n

\u00a0\u00a0\u00a0the method and timing of payment;<\/p>\n\n

\u00a0\u00a0\u00a0the method and time limit for exercising the right of withdrawal, or the absence of such a right, where that follows from applicable law;<\/p>\n\n

\u00a0\u00a0\u00a0the rules governing the Seller's liability for conformity of the goods with the contract, and any voluntary warranty, where one has been granted.<\/p>\n\n

Confirmation of the contract or the terms of the order is provided to the Customer on a durable medium, in particular by email.<\/p>\n\n

\u00a7 4. Products and the Nature of Orders<\/strong><\/p>\n\n

The Seller offers:<\/p>\n\n

\u00a0\u00a0\u00a0Ready-made products;<\/p>\n\n

\u00a0\u00a0\u00a0Custom products;<\/p>\n\n

\u00a0\u00a0\u00a0accessories or other products indicated by the Seller in its current offering.<\/p>\n\n

For Custom products, the final scope of the deliverable is determined individually between the parties through correspondence or another agreed form of communication.<\/p>\n\n

The Customer is responsible for the accuracy of the specifications, dimensions, functional preferences, and other information provided that is necessary to make the Custom product.<\/p>\n\n

Renderings, photos, drawings, descriptions, and information about the steel, handle material, and finish are provided for illustrative purposes. Given the handmade nature of the product, minor variations that don't affect conformity with the contract are permitted.<\/p>\n\n

\u00a7 5. Placing Orders and Entering Into the Contract<\/strong><\/p>\n\n

Sales take place through direct communication with the Seller, in particular via the contact form, email, or another individually agreed method.<\/p>\n\n

As a rule, the process of entering into a contract includes the following steps:<\/p>\n\n

\u00a0\u00a0\u00a0the Customer submits an inquiry about a Ready-made product or a Custom product;<\/p>\n\n

\u00a0\u00a0\u00a0the Seller provides information about the product, price, estimated fulfillment time, and expected delivery costs;<\/p>\n\n

\u00a0\u00a0\u00a0the parties agree on all essential order terms, including product specifications, price, and method of payment and delivery;<\/p>\n\n

\u00a0\u00a0\u00a0the Customer places the order and confirms their intent to enter into the contract;<\/p>\n\n

\u00a0\u00a0\u00a0the Seller sends confirmation that the order has been accepted for fulfillment.<\/p>\n\n

The contract is concluded once the Seller's confirmation of acceptance of the order is delivered to the Customer, unless the parties expressly agree otherwise.<\/p>\n\n

If the order is for a Custom product, confirmation of acceptance may be conditional on prior payment of the full price or a deposit, if such terms have been individually agreed.<\/p>\n\n

The Seller may decline to accept an order for fulfillment if:<\/p>\n\n

\u00a0\u00a0\u00a0fulfilling the order is impossible for technical, material, or legal reasons;<\/p>\n\n

\u00a0\u00a0\u00a0the data provided by the Customer is incomplete or raises reasonable doubts;<\/p>\n\n

\u00a0\u00a0\u00a0the Customer does not accept the terms presented by the Seller;<\/p>\n\n

\u00a0\u00a0\u00a0there is a reasonable risk of violating the law of the destination country or transport restrictions applicable to knives.<\/p>\n\n

If fulfilling the order becomes impossible after the contract is concluded, the Seller will promptly notify the Customer and refund any payments received to the extent the deliverable cannot be provided.<\/p>\n\n

\u00a7 6. Prices and Payment<\/strong><\/p>\n\n

Prices for Ready-made products are stated by the Seller in the offer; prices for Custom products are agreed individually.<\/p>\n\n

The price quoted to the Customer is a gross (tax-inclusive) price, unless the offer expressly states otherwise.<\/p>\n\n

Delivery costs and other costs directly related to fulfilling the order may be added to the product price; the Customer will be informed of these before the contract is concluded.<\/p>\n\n

Available payment methods include, at minimum, bank transfer. The Seller may also accept other forms of payment, in particular electronic payment or payment in cryptocurrency, if this is expressly indicated to the Customer before the contract is concluded.<\/p>\n\n

If the parties agree on payment in cryptocurrency:<\/p>\n\n

\u00a0\u00a0\u00a0the payment terms, including the type of cryptocurrency, wallet address, payment deadline, and any exchange-rate settlement rules, are agreed individually in each case;<\/p>\n\n

\u00a0\u00a0\u00a0payment is considered effective at the moment the transaction is confirmed in accordance with the agreed terms;<\/p>\n\n

\u00a0\u00a0\u00a0in the event of non-performance of the contract or an accepted withdrawal, funds are generally refunded in the same form of payment, unless the parties agree on another solution consistent with applicable law;<\/p>\n\n

\u00a0\u00a0\u00a0the Seller is not liable for incorrect wallet details provided by the Customer or for exchange-rate fluctuations occurring after payment has been made, unless mandatory law provides otherwise.<\/p>\n\n

For Custom products, the Seller may require full prepayment of 100% of the price, or a deposit in an agreed amount, before work begins.<\/p>\n\n

If the Customer does not make payment by the agreed deadline, the Seller may suspend fulfillment of the order or withdraw from fulfilling it after setting an additional payment deadline, unless the parties have agreed otherwise.<\/p>\n\n

\u00a7 7. Order Fulfillment, Delivery, and Transfer of Risk<\/strong><\/p>\n\n

The order fulfillment time is agreed individually with the Customer before the contract is concluded.<\/p>\n\n

For Custom products, the fulfillment time is estimated, unless the parties expressly agree on a binding deadline.<\/p>\n\n

The Seller ships orders through selected carriers, in particular UPS, DHL, DPD, InPost, or Poczta Polska, or another carrier appropriate for the given order.<\/p>\n\n

Delivery costs are determined individually for each order, taking into account the delivery location, the required mode of transport, and the value of the shipment.<\/p>\n\n

For deliveries outside the European Union, the Customer is responsible for all customs duties, import taxes, and other mandatory public-law charges in the destination country, unless the parties expressly agree otherwise.<\/p>\n\n

Before placing an order, the Customer must make sure that possessing, importing, transporting, and using the ordered product is lawful in the country the product will be shipped to. The Seller is not liable for the consequences of the Customer's violation of local law, including the seizure or confiscation of a shipment by the relevant authorities, where this is due to the product's non-compliance with the law of the destination country.<\/p>\n\n

In relations with a Consumer or a Privileged entrepreneur, the risk of accidental loss of or damage to the product passes to the Customer upon delivery of the product to the Customer. Delivery of the product to a carrier is treated as delivery to the Customer only if the Customer independently chose a carrier not offered by the Seller.<\/p>\n\n

In relations with a Customer who is neither a Consumer nor a Privileged entrepreneur, the risk of accidental loss of or damage to the product passes to the Customer upon delivery of the product to the carrier.<\/p>\n\n

The Customer should inspect the condition of the shipment upon receipt and, if transport damage is found, should, where possible, prepare a damage report with the carrier and promptly notify the Seller.<\/p>\n\n

\u00a7 8. Right of Withdrawal<\/strong><\/p>\n\n

A Consumer or Privileged entrepreneur who has entered into a distance contract may withdraw from the sales contract for a Ready-made product without giving a reason, within 14 days of taking possession of the product, either personally or through a third party other than the carrier designated by the Customer.<\/p>\n\n

To meet this deadline, it's sufficient to send the withdrawal notice before it expires.<\/p>\n\n

The withdrawal notice may be submitted:<\/p>\n\n

\u00a0\u00a0\u00a0by email to info@revasdomo.pl;<\/p>\n\n

\u00a0\u00a0\u00a0in writing to the Seller's registered address;<\/p>\n\n

\u00a0\u00a0\u00a0using the model withdrawal form, which is provided by the Seller as a separate document.<\/p>\n\n

Upon a valid withdrawal:<\/p>\n\n

\u00a0\u00a0\u00a0the contract is treated as never having been concluded;<\/p>\n\n

\u00a0\u00a0\u00a0the Seller will refund all payments received from the Customer, including the cost of the cheapest standard delivery method offered by the Seller, promptly, and no later than within 14 days of receiving the withdrawal notice;<\/p>\n\n

\u00a0\u00a0\u00a0the Seller may withhold the refund until the returned product has been received, or until proof that it has been shipped back has been provided, whichever occurs first;<\/p>\n\n

\u00a0\u00a0\u00a0the refund will be made using the same payment method the Customer used, unless the Customer expressly agrees to a different method that involves no additional cost to them.<\/p>\n\n

The Customer should return the product promptly, and no later than within 14 days from the date the withdrawal notice was submitted. To meet this deadline, it's sufficient to send the product back before it expires.<\/p>\n\n

The Customer bears the direct cost of returning the product, unless the Seller expressly agrees to cover it.<\/p>\n\n

The Customer is liable for any decrease in the product's value resulting from handling it in a way that goes beyond what is necessary to establish its nature, characteristics, and function.<\/p>\n\n

The right of withdrawal does not apply in cases provided for by mandatory law, in particular with respect to Custom products, i.e., non-prefabricated items made to the Customer's specifications or intended to meet their individualized needs.<\/p>\n\n

\u00a7 9. Complaints and the Seller's Liability for Conformity with the Contract<\/strong><\/p>\n\n

The Seller is liable to a Consumer and to a Privileged entrepreneur for the conformity of the product with the contract, under the rules set out in the Polish Consumer Rights Act.\nIf a product is not in conformity with the contract, the eligible Customer may request its repair or replacement.\nIf the Seller:\nhas refused to bring the product into conformity with the contract;\nhas not brought the product into conformity with the contract within a reasonable time and without excessive inconvenience to the Customer;\nthe non-conformity persists despite an attempt to bring the product into conformity;\nthe non-conformity is significant enough to justify a price reduction or withdrawal from the contract without a prior request for repair or replacement;\nit's clear from the Seller's statement or from the circumstances that the product will not be brought into conformity within a reasonable time or without excessive inconvenience to the Customer, the Customer may submit a statement requesting a price reduction or withdrawal from the contract, in accordance with applicable law.\nA complaint may be filed:\nby email to info@revasdomo.pl;\nin writing to the Seller's registered address.\nTo help us process a complaint more efficiently, we recommend the Customer include:\nfirst and last name or company name;\ncontact details;\norder number or other information allowing the transaction to be identified;\na description of the non-conformity or defect;\nthe requested resolution, if the Customer wishes to specify one;\nphoto documentation, if it may help assess the claim.\nThe Seller will respond to a complaint from a Consumer or Privileged entrepreneur within 14 days of receiving it, where the law provides for such an effect for the given type of request.\nThe cost of handling a complaint, including any costs of removal, delivery, labor, materials, and reinstallation or setup of the product, is borne by the Seller to the extent required by mandatory law.\nThis section does not exclude, limit, or suspend any rights arising from mandatory provisions of applicable law.<\/p>\n\n

\u00a0\u00a0\u00a03) niezgodno\u015b\u0107 z umow\u0105 wyst\u0119puje nadal mimo pr\u00f3by doprowadzenia produktu do zgodno\u015bci z umow\u0105;<\/p>\n\n

\u00a0\u00a0\u00a04) niezgodno\u015b\u0107 z umow\u0105 jest na tyle istotna, \u017ce uzasadnia obni\u017cenie ceny albo odst\u0105pienie od umowy bez uprzedniego \u017c\u0105dania naprawy lub wymiany;<\/p>\n\n

\u00a0\u00a0\u00a05) z o\u015bwiadczenia Sprzedawcy lub okoliczno\u015bci wyra\u017anie wynika, \u017ce nie doprowadzi produktu do zgodno\u015bci z umow\u0105 w rozs\u0105dnym czasie lub bez nadmiernych niedogodno\u015bci dla Klienta,<\/p>\n\n

Klient mo\u017ce z\u0142o\u017cy\u0107 o\u015bwiadczenie o obni\u017ceniu ceny albo odst\u0105pieniu od umowy, zgodnie z obowi\u0105zuj\u0105cymi przepisami.<\/p>\n\n

4. Reklamacj\u0119 mo\u017cna z\u0142o\u017cy\u0107:<\/p>\n\n

5. Dla sprawniejszego rozpoznania reklamacji zaleca si\u0119 podanie przez Klienta:<\/p>\n\n

\u00a0\u00a0\u00a01) imienia i nazwiska lub nazwy;<\/p>\n\n

\u00a0\u00a0\u00a02) danych kontaktowych;<\/p>\n\n

\u00a0\u00a0\u00a03) numeru zam\u00f3wienia lub innych danych pozwalaj\u0105cych zidentyfikowa\u0107 transakcj\u0119;<\/p>\n\n

\u00a0\u00a0\u00a04) opisu niezgodno\u015bci albo wady;<\/p>\n\n

\u00a0\u00a0\u00a05) \u017c\u0105danego sposobu za\u0142atwienia reklamacji, o ile Klient chce go wskaza\u0107;<\/p>\n\n

\u00a0\u00a0\u00a06) dokumentacji zdj\u0119ciowej, je\u017celi mo\u017ce u\u0142atwi\u0107 ocen\u0119 zg\u0142oszenia.<\/p>\n\n

6. Sprzedawca udziela odpowiedzi na reklamacj\u0119 Konsumenta lub Przedsi\u0119biorcy uprzywilejowanego w terminie 14 dni od dnia jej otrzymania, je\u017celi przepisy prawa przewiduj\u0105 taki skutek dla danego rodzaju \u017c\u0105dania.<\/p>\n\n

7. Koszty reklamacji, w tym koszty demonta\u017cu, dostarczenia, robocizny, materia\u0142\u00f3w oraz ponownego zamontowania lub uruchomienia produktu, ponosi Sprzedawca w zakresie przewidzianym przez bezwzgl\u0119dnie obowi\u0105zuj\u0105ce przepisy prawa.<\/p>\n\n

8. Postanowienia niniejszego paragrafu nie wy\u0142\u0105czaj\u0105, nie ograniczaj\u0105 ani nie zawieszaj\u0105 uprawnie\u0144 wynikaj\u0105cych z bezwzgl\u0119dnie obowi\u0105zuj\u0105cych przepis\u00f3w prawa.<\/p>\n\n

\u00a7 10. Voluntary \"Lifetime Warranty\"<\/strong><\/p>\n\n

Independent of its statutory liability, the Seller provides a voluntary \"Lifetime Warranty\" covering material and manufacturing defects arising from causes inherent to the product.<\/p>\n\n

The warranty covers only the original purchaser of the product, unless the warranty document or a separate statement from the Seller provides otherwise.<\/p>\n\n

Under the warranty, the Seller, at its own discretion and taking into account the nature of the claim, will:<\/p>\n\n

\u00a0\u00a0\u00a0repair the product;<\/p>\n\n

\u00a0\u00a0\u00a0replace the product with the same or an equivalent one;<\/p>\n\n

\u00a0\u00a0\u00a0decline to honor the warranty claim if grounds for excluding warranty liability apply.<\/p>\n\n

The warranty does not cover damage arising in particular from:<\/p>\n\n

\u00a0\u00a0\u00a0improper use, including throwing the knife, using it as a pry bar, chopping wood, or batoning, unless the Seller has expressly stated that a given model is intended for such uses;<\/p>\n\n

\u00a0\u00a0\u00a0washing the product in a dishwasher or using it contrary to the care instructions;<\/p>\n\n

\u00a0\u00a0\u00a0unauthorized repairs, modifications, mechanical sharpening contrary to the guidelines, or interference by third parties;<\/p>\n\n

\u00a0\u00a0\u00a0normal wear from use, including a dulled edge, patina on carbon steel, minor scratches, or changes resulting from ordinary use;<\/p>\n\n

\u00a0\u00a0\u00a0improper storage, corrosion caused by neglect, or force majeure.<\/p>\n\n

A warranty claim should be sent to info@revasdomo.pl with a description of the issue and, where possible, photo documentation.<\/p>\n\n

The Seller will inform the claimant of the next steps, including how the product may need to be sent in for inspection or repair.<\/p>\n\n

This warranty is voluntary and does not exclude, limit, or suspend the Customer's rights arising from the provisions on conformity of goods with the contract.<\/p>\n\n

\u00a7 11. Liability and Safe Use<\/strong><\/p>\n\n

The knives offered by the Seller are sharp tools and require responsible use consistent with their intended purpose.<\/p>\n\n

The Customer must use the product in accordance with its intended purpose, technical properties, and applicable safety rules.<\/p>\n\n

The Seller is not liable for damage resulting from use of the product contrary to its intended purpose, violation of safety rules, or violation of local laws governing the possession, carrying, transport, or import of knives, subject to the limitations arising from mandatory provisions of applicable law.<\/p>\n\n

For Customers who are neither Consumers nor Privileged entrepreneurs, the Seller's liability for non-performance or improper performance of the contract is limited to the net price paid for the relevant product, unless the damage was caused intentionally.<\/p>\n\n

\u00a7 12. Personal Data and Newsletter<\/strong><\/p>\n\n

The rules for processing the personal data of Customers, people who contact the Seller, and newsletter subscribers are set out in a separate Privacy and Cookie Policy available on the site.<\/p>\n\n

The newsletter is voluntary and is provided only on the basis of prior consent, where such consent is required by applicable law.<\/p>\n\n

The Customer may unsubscribe from the newsletter at any time using the unsubscribe link in the email or by contacting the Seller.<\/p>\n\n

\u00a7 13. Out-of-Court Dispute Resolution<\/strong><\/p>\n\n

A Consumer may make use of out-of-court methods for handling complaints and pursuing claims in accordance with applicable law, in particular by contacting the relevant local consumer ombudsman, the Provincial Trade Inspectorate, or another authorized body.<\/p>\n\n

Detailed information on out-of-court dispute resolution methods can be found, among other places, on the websites of the Polish Office of Competition and Consumer Protection (UOKiK) and other relevant public institutions.<\/p>\n\n

This section is provided for informational purposes and does not constitute an obligation on the part of the Seller to take part in out-of-court dispute resolution proceedings, unless such an obligation arises from mandatory law.<\/p>\n\n

\u00a7 14. Final Provisions\nContracts entered into under these Terms are governed by Polish law, provided that the choice of Polish law does not deprive the Consumer of the protection granted under provisions that cannot be excluded by contract under the law of the country of their habitual residence.\nFor Customers who are neither Consumers nor Privileged entrepreneurs, disputes will be resolved by the court with jurisdiction over the Seller's registered address.\nThe Seller may amend these Terms for valid reasons, in particular due to:\nchanges in the law;\nchanges in payment or delivery methods;\nan expansion or change in the scope of the offering;\nthe need to clarify these Terms.\nContracts entered into before a change to these Terms are governed by the Terms in effect at the time the contract was concluded.\nThese Terms take effect on the date of publication on the site.<\/strong><\/p>\n\n

1. Do um\u00f3w zawieranych na podstawie Regulaminu stosuje si\u0119 prawo polskie, z zastrze\u017ceniem, \u017ce wyb\u00f3r prawa polskiego nie pozbawia Konsumenta ochrony przyznanej mu na podstawie przepis\u00f3w, kt\u00f3rych nie mo\u017cna wy\u0142\u0105czy\u0107 w drodze umowy, obowi\u0105zuj\u0105cych w pa\u0144stwie jego zwyk\u0142ego pobytu.<\/p>\n\n
